Functions, Duties, and Powers under Article 249 of the Constitution of Nepal and Section 4 of the National Human Rights Commission Act, 2011 (2068 B.S.)

Mandate:
The Commission is entrusted with the responsibility to ensure respect, protection, and promotion of human rights, and to guarantee their effective implementation.

In pursuance of this mandate, the Office undertakes the following actions:

  1. Investigation and Inquiry
    • Examine petitions or complaints submitted by victims or on their behalf, or matters received from any source regarding human rights violations or encouragement thereof.
    • Conduct investigations in coordination with the central office and submit reports accordingly.
  2. Monitoring of Duty-Bearers
    • Investigate cases where officials responsible for preventing human rights violations fail to fulfill their duties or show negligence.
    • Recommend departmental action against such officials through reports to the Commission.
  3. Legal Action Recommendations
    • Recommend to the Commission the filing of cases in court under the law against individuals or institutions found to have violated human rights.
  4. Coordination with Civil Society
    • Collaborate with civil society organizations to enhance awareness and consciousness of human rights.
  5. Recommendations for Disciplinary Action
    • Recommend departmental action and punishment against human rights violators, with reasons and grounds clearly stated.
  6. Review of Human Rights Laws
    • Periodically review laws related to human rights and undertake necessary work for their improvement and amendment.
  7. International Treaties and Agreements
    • Undertake necessary actions regarding international treaties or agreements on human rights that Nepal should become a party to.
    • Monitor the implementation of treaties or agreements to which Nepal is already a party and submit monitoring reports to the Commission.
  8. Quasi-Judicial Powers
    • Exercise powers equivalent to those of a court in summoning persons, recording statements or affidavits, receiving evidence, and requiring submission of documentary proof.
  9. Search and Seizure in Serious Cases
    • Upon receiving information of serious or imminent human rights violations, enter residences or offices without prior notice, conduct searches, and seize documents or evidence related to violations.
  10. Rescue Operations
    • In cases where immediate action is necessary to prevent ongoing violations, enter government offices or other places without prior notice and carry out rescue operations.
